Terms of Service

Sculpted Soul Collective (“SSC,” “we,” or “us”) owns and operates this website (“Site”). These Terms of Service (“Terms”) constitute a legally binding agreement between SSC and "you", the user of this Site. If you are using the Site on behalf of an entity, you represent that you have the authority to bind that entity to these Terms. Acceptance of Terms.

By accessing or using any part of the Site or our services (“Services”), you acknowledge that you have read, understood, and agree to be bound by these Terms, which include an arbitration agreement, a waiver of class-action rights, and limitations on liability. 1. GENERAL

Eligibility. To use our website ("Site"), you must be at least 18 years old and legally capable of entering into agreements. If you have been restricted from accessing our Site or services in the past, you are not permitted to use them.

License to Use the Site. Subject to your compliance with these Terms, Sculpted Soul Collective ("SSC") grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and our services for personal, non-commercial purposes. We reserve the right to monitor usage to ensure compliance with these Terms.

Prohibited Conduct. You agree not to: (a) Copy, distribute, modify, or reproduce any content from the Site. (b) Use our Site or services for commercial purposes. (c) Reverse-engineer or tamper with our technology. (d) Disrupt the functionality of the Site or services. (e) Misrepresent your identity or attempt unauthorized access. (f) Collect information from users without consent. (g) Violate intellectual property rights or third-party terms. (h) Violate any laws or regulations. (i) Interfere with others’ ability to use our Site or services.

Privacy Policy. SSC’s Privacy Policy (which describes how we collect, use and disclose your data and your consent to such collection, use, and disclosure) is incorporated into and is a part of these Terms.

2. ACCOUNT REGISTRATION & USAGE

Account Creation. If you create an account, you must provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

Account Security. Notify us immediately of any unauthorized use of your account. SSC is not liable for any loss resulting from unauthorized use of your credentials.

No Obligation to Retain Data. SSC is not required to retain or store any account information or data.

3. HEALTH & WELLNESS DISCLAIMER

SSC products and services are not intended to diagnose, treat, or cure any medical or psychological conditions. We are not licensed healthcare professionals, and the content on our Site should not be interpreted as medical advice. Consult a qualified professional before making health-related decisions.

Engaging in physical wellness activities carries risks. By using our services, you acknowledge and accept these risks and agree to participate within your own physical and mental limits.

4. TERMS OF SALE

Product Descriptions. We strive for accuracy but do not guarantee that all product descriptions, pricing, or availability information is error-free.

Pricing & Availability. Prices and product availability may change at any time. Sales are only available in the U.S., and prices are listed in U.S. dollars.Purchasing. Placing an order constitutes an offer to buy. We reserve the right to accept or reject orders at our discretion.

Personal Use Only. Products are for your personal use only. You agree not sell or resell any products you purchase. Except where prohibited by law, we may limit the quantity of Products available for purchase. We reserve the right, with or without notice, to cancel or reduce the quantity of any order to be filled or products to be provided to you that may result in a violation of these Terms, as we determine in our sole discretion.

Returns. All sales are final; we do not accept returns or exchanges.

Damaged Shipments. If your order arrives damaged or incomplete, contact us within 14 days of receipt for resolution.

Payment. You authorize us (and any payment processor) to charge your payment card for all purchases you make. We accept the forms of payment stated on the Site and, for credit card payments, charge your credit card when your order is processed. The bank issuing your credit card may control when to release funds in the case of an order cancellation or refund. We reserve the right to use the payment information you provide us in connection with this payment to provide better service to you should you wish to use our service again in the future and to protect us from fraud and other losses. Completion of a payment transaction is contingent upon: (a) you providing complete personal, account, transaction and any other information needed, (b) authorization of the payment by your credit or debit card company, and (c) acceptance of your payment. You may cancel your payment prior to your final submission of it to us. We may, in our sole discretion, cancel your payment at any time by providing notice to you through your contact information or by a notice when you attempt to make a payment. We may cancel a payment or prevent you from initiating future payments for any reason, including, without limitation, the following: (i) if you attempt to use the Services in breach of any applicable law or regulation, including the card network rules or regulations; (ii) if you use the Services in breach of these Terms; (iii) if we suspect fraudulent, unlawful or improper activity regarding a payment; (iv) if we detect, in our sole discretion, that your payments have excessive disputes, high reversal rates or present a relatively high risk of losses; or (v) failure to cooperate in an investigation or provide additional information when requested.

Shipping & Risk of Loss. Title and risk transfer to you upon delivery to the carrier. We are not responsible for shipping delays or lost packages.Taxes. Customers are responsible for any applicable federal, provincial, and local taxes related to their purchase. Taxes will be calculated at checkout based on your shipping address. For Canadian orders, GST, HST, or PST may apply depending on your province.

5. SHIPPING & RETURN POLICY

Order Processing & Fulfillment. Orders are processed within 2-4 business days (excluding weekends and holidays). Orders placed on weekends or holidays will begin processing the next business day. Pre-order and custom items may have longer processing times (details will be provided in product descriptions).

Shipping Methods & Delivery Estimates. We currently offer the following shipping options within Canada only:

Standard Shipping: 5-7 business days
Expedited Shipping: 2-3 business days

Overnight Shipping: 1 business day (if placed before 12 PM PST)Delivery times are estimates and are not guaranteed, as they may be affected by weather, carrier delays, or other unforeseen circumstances.Shipping Fees. Shipping costs are calculated at checkout based on location and selected shipping method. We do not offer free shipping at this time; however, promotional free shipping offers may be available from time to time. Any free shipping promotions will be clearly stated on the Site (applied through a one-time-use coupon code, or automatically applied, at checkout if eligible). Promotional free shipping is limited to one use per customer, unless otherwise specified.

Shipping Limitations. We currently only ship within the US and Canada. We do not ship to PO boxes or APO/FPO addresses.

Order Tracking & Lost Packages. Once your order ships, you will receive a tracking number via email. Please allow 24-48 hours for tracking updates. SSC is not responsible for lost, stolen, or delayed shipments once they have been handed over to the carrier. If your package is marked as delivered but not received, check with neighbors or your local carrier before contacting us. Customers must file claims directly with the shipping provider for lost or delayed orders.

Return Policy. All sales are final. We do not accept returns or exchanges unless an item is defective or incorrect upon arrival.

Damaged or Incorrect Shipments. If your order arrives damaged, defective, or incorrect, you must contact us within 7 days of delivery at orders@sculptedsoulcollective.com with photos of the issue. If approved, we will issue a replacement or store credit. Returns for defective or incorrect items must be shipped back within 7 days of approval.

Return Shipping Fees. Customers are responsible for return shipping & handling costs unless the item was received in error or damaged upon arrival.

Final Sale Item. All sale items, gift cards, and personal care products (including skincare and matcha) are final sale and non-returnable.

6. USER CONTENT

By submitting content (e.g., reviews, comments) to SSC, you grant us a non-exclusive, royalty-free, perpetual license to use and display your content. You are solely responsible for your submitted content and must ensure it does not violate third-party rights.CONTRIBUTIONS TO SSCAny text, photographs, artwork, ideas, questions, reviews, comments, suggestions or other content that you submit or post to the Site or otherwise provide to us are referred to as “User Content”. The following terms apply to User Content:

License to SSC. By sharing, submitting or uploading any User Content, you grant SSC a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, sublicensable and transferable license to use, copy, distribute, display, publish, perform, sell, transmit, adapt, translate, modify, reverse-engineer, disassemble and create derivative works from your User Content in any manner existing now or created in the future. Subject to the license above, you retain ownership of User Content.

Waiver of Moral Rights. You irrevocably waive and agree not to assert any rights, including any “moral rights,” that you have to prevent us from exploiting the rights granted in Section.

Right to Name and Likeness. You also grant us the right to use and display the name, photograph and any other biographical information that you submit with any User Content in connection with such User Content.

Your Responsibility for User Content. You acknowledge and agree that you are solely responsible for all the User Content that you make available through the Site. Accordingly, you represent and warrant that: (1) you have all rights, licenses, consents and releases necessary to grant SSC the required rights to disseminate any User Content and (2) neither your User Content nor your posting, uploading, publication, submission or transmittal of this User Content or SSC’s use of your uploaded User Content (or any portion thereof) on, through or by the means of the Site, will infringe, misappropriate or violate a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights or rights of publicity or privacy or result in the violation of any applicable law or regulation.

No Obligations Regarding User Content. We will not have any obligation to hold any User Content in confidence or compensate you or anyone else for its use. We have the right to remove or edit any User Content for any reason or no reason at all.

7. INTELLECTUAL PROPERTY & COPYRIGHT INFRINGEMENT

SSC respects intellectual property rights and expects users to do the same. If you believe content on our Site infringes copyright, contact us with details of the alleged infringement.

8. DISCLAIMERS & LIMITATIONS OF LIABILITY

No Warranties. Our Site and services are provided "as is" without warranties of any kind. We do not guarantee uninterrupted, error-free service.

Limitation of Liability. To the fullest extent allowed by law, SSC is not liable for indirect, incidental, or consequential damages resulting from your use of our Site or services.

Indemnification. You agree to indemnify and hold SSC and its affiliates harmless from any claims, damages, or expenses arising from your use of our Site or services.

9. TERMINATION

We reserve the right to suspend or terminate your access to our Site or services at any time, for any reason, without prior notice.

10. DISPUTES & GOVERNING LAW

Dispute Resolution. If you have a dispute with us, please contact us first. If resolution is not reached, disputes shall be settled through binding arbitration.

Governing Law. These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

11. GENERAL TERMS

Force Majeure. We are not liable for delays or failures beyond our control.

Severability. If any provision is deemed unenforceable, the rest of these Terms remain in effect.

Modifications. We reserve the right to update these Terms at any time. Continued use of our Site constitutes agreement to the updated Terms.
